Number of complaints on organisation of public procurement is not decreasing

In 2022 there were 1,131 complaints and appeals from bidders regarding their organization. This is up by 1.1% from the previous year. A report https://etender.gov.az/hesabat-13 of the State Service for Antimonopoly Surveillance and Consumer Market Control under the Ministry of Economy reads this. The issues raised in the complaints were investigated in line with the Law on Public Procurement. Based on their results, recommendations were given to procurement organisations for conducting tenders under objective conditions, fair treatment of bidders and non-discrimination. Explanations on the provisions of the legislation governing public procurement were also provided, the report said. At the same time, the agency does not provide statistics on persistent violators of the public procurement law. According to the results of open tenders, requests for proposals and quotations, 10,595 final protocols were received from procuring entities. Deficiencies were found in 1,409 protocols or 13.3% of them. In this regard, the procuring entities were advised to cancel the results of these procurements. It has to be kept in mind that in Azerbaijan, final protocols of competitive procurements are not public. Therefore, the names of members of tender commissions, bidders and the value of their bids remain closed to the public. Moreover, in violation of the "Law on Public Procurement", the anti-monopoly authority does not maintain a register of untrustworthy suppliers of goods (works and services).
